EVENT TERMS, CONDITIONS & LIABILITY WAIVER
(For Invitees / Non-Members)
These Event Terms and Conditions (“Terms”) apply to any person (“Participant”) who registers for, attends, or participates in any event organized, hosted, or coordinated by Forever Drift Lifestyle, operated by Soundwellmac, LLC, a California limited liability company (“Company”).
By requesting an invitation, registering, purchasing a ticket, or attending an event, Participant agrees to the following:
1. PRIVATE EVENT STATUS
Events hosted by Forever Drift Lifestyle are private, invitation-based gatherings.
Participation is subject to approval and may be denied or revoked at the discretion of the Company.
Attendance at an event does not grant membership to Forever Drift Lifestyle.
2. EVENT CONTRIBUTION FEES
Participants may be required to pay Event Contribution Fees, which may cover:
Venue reservations
Restaurant buyouts
Hotel accommodations
Transportation coordination
Yacht or watercraft charter
Rally coordination
Production / photography / videography
Event staffing
Security
Administrative coordination
All event payments are:
Due in advance
Non-refundable unless otherwise stated
Subject to vendor commitments and minimum attendance
3. NON-REFUNDABLE VENDOR COSTS
Participants acknowledge that many event expenses are prepaid to third-party vendors.
Once funds have been committed or paid to vendors including but not limited to:
Hotels
Restaurants
Charter companies
Venues
Transportation providers
Those amounts cannot be refunded under any circumstances.
4. EVENT CHANGES
The Company reserves the right to:
Modify event schedules
Change venues
Adjust activities
Cancel events due to safety, weather, vendor issues, or insufficient participation
If an event is canceled by the Company, refunds may be issued at the Company’s discretion minus vendor commitments.
5. ASSUMPTION OF RISK
Participants acknowledge that activities may include:
Driving or riding in high-performance vehicles
Group driving events or rallies
Social gatherings where alcohol is served
Outdoor or waterfront activities
Travel to various locations
These activities involve inherent risks including but not limited to:
Vehicle accidents
Injury
Property damage
Serious bodily harm
Permanent disability
Death
Participant voluntarily assumes all risks, whether known or unknown.
6. LIABILITY WAIVER
To the fullest extent permitted under California law, Participant releases and forever discharges:
Forever Drift Lifestyle
Soundwellmac, LLC
Its members, managers, employees, contractors
Event organizers
Sponsors
Hosts
Other participants
From any and all claims arising from participation in the event, including claims related to:
Personal injury
Property damage
Vehicle incidents
Alcohol consumption
Third-party vendor services
Negligence (except gross negligence where prohibited by law)
7. CALIFORNIA CIVIL CODE §1542 WAIVER
Participant waives rights under California Civil Code §1542, which states:
“A general release does not extend to claims that the creditor does not know or suspect to exist…”
Participant understands and agrees this waiver applies to unknown claims.
8. VEHICLE RESPONSIBILITY
Participants operating vehicles acknowledge that:
They are responsible for their own vehicle
They must maintain proper insurance
They must possess a valid driver’s license
They assume all liability related to their vehicle and driving conduct
The Company does not provide vehicle insurance coverage.
9. ALCOHOL & CONDUCT POLICY
Participants agree:
Not to drive under the influence of alcohol or drugs
To follow all traffic laws and safety instructions
To behave respectfully toward other attendees
The Company may remove any participant for safety concerns or misconduct without refund.
10. THIRD-PARTY SERVICES
Events may involve third-party vendors including:
Hotels
Restaurants
Charter providers
Transportation providers
Venues
The Company is not responsible for acts, delays, failures, or negligence of third-party vendors.
11. MEDIA RELEASE
Participant grants the Company permission to:
Photograph
Film
Record
Participant’s image, voice, likeness, and vehicle for promotional or commercial purposes without compensation.
12. NON-DISPARAGEMENT
Participants agree not to publish false, misleading, or damaging statements about the Company, its organizers, or participants.
Before posting complaints publicly, Participant must provide written notice and allow the Company 30 days to address the concern.
13. CONFIDENTIALITY
Participant agrees not to disclose non-public information about the event including:
Private locations
Guest lists
Vendor relationships
Internal operations
14. INDEMNIFICATION
Participant agrees to indemnify and hold the Company harmless from claims arising from:
Participant conduct
Damage caused by Participant
Violations of law
Breach of these Terms
15. DISPUTE RESOLUTION
Before initiating arbitration, Participant agrees to attempt good faith negotiation for at least 30 days.
Any unresolved dispute shall be resolved exclusively by binding arbitration in Orange County, California under the rules of the American Arbitration Association (AAA).
Participants waive:
Jury trial
Class action proceedings
16. LIMITATION OF LIABILITY
To the fullest extent permitted by law, the Company’s liability shall not exceed the total event fees paid by the Participant.
17. ACKNOWLEDGMENT
By registering for the event, Participant confirms that they:
Have read and understood these Terms
Voluntarily assume all risks
Agree to the liability waiver and arbitration provisions
